    5. C. I. F. PROCEDURE

    5.1 Seller and Buyer sign and seal contract with full banking coordinates.

    5.2 On behalf of Buyer, a bank letter of undertaking will be sent within five (5) banking days from execution of the contract to the Seller’s bank to request confirmation that the Seller’s bank will issue 2% performance bond of the total monthly value of the contract, upon receipt of the Buyer’s Proof of Funds MT799 (POF). (As below).

    5.3 Seller’s bank, within five (5) banking days from receipt of the Buyer’s Proof of Funds MT799 (POF), shall provide the Buyer with either a two percent (2%) pre-advice Performance Guarantee or a Letter of Undertaking from one of the top 25 prime world banks. If the Seller elects to issue the Letter of Undertaking, this letter should include the text to be used in the Performance Guarantee to Buyer’s bank,

    5.4. The Buyer's bank in no more than five (5) banking days, from receipt of either the two percent (2%) pre-advice Performance Guarantee or the Letter of Undertaking, shall open the agreed Documentary Letter of Credit or (MT799 POF), in favor of the Seller, and upon the issuance of Buyer’s reinstating Documentary Letter of Credit, Seller shall provide Proof of Product (POP) and the Performance Guarantee shall become operative.

    5.5Exactly seven (10) days after confirmation of the buyer POF, seller furnishes buyer with reassignment of the cargo in the buyers name together with tanker loading approval, loading date, and charter party/vessel particulars. Loading commence after fourteen (14) days the loading date is issued. Seller calls the Buyers inspectors on Board for Q&Q the same inspectors at the loading point is same the at Discharge point.

    Delivery is done not later than 21 days after the loading.

    5.6 Deliveries commence as per the contract and continue until aggregate quantity is completed.

    5.7 Once each loading is completed, seller is to provide non-negotiable copies of the original shipping documents issued in buyer's name to the buyer or his agent. Should any amendments to the Letter of Credit be requested, once the same has already been issued; the party requesting the change will be responsible for the payment of the related costs

    (a) Full set of Original Bill of Lading stamped 'Freight Pre Paid”

    (b) Full set of Certificates of Quality

    (c) Full set of Certificates of Quantity

    (d) Full set of Certificate Origin

    (e) Full set of Certificate of authenticity/Warranty of Title issued by NNPC.

    (f) Cargo Manifest

    (g) Tanker Ullage Sheet

    (h) Tanker time sheet

    (i) Early departure procedures

    (j) Master's Receipt for Samples

    (k) Master receipt for documents

    (l) Certified true copy of Remittance Certificate for immediate preceding shipment (applicable for 2nd shipment to the end)pies of the original shipping documents issued in buyer's name to the buyer or his agent. Should any amendments to the Letter of Credit be requested, once the same has already been issued; the party requesting the change will be responsible for the payment of the related costs

    5.8 The originals, including three copies of each, shall be sent to Buyer by courier

    immediately upon completion, to enable Buyer to verify them without delay.

    (a) On arrival of vessel, prior to discharge, a random sampling of product will be tested to determine quality of product on board by SGS quality control report at discharge port.

    (b) Final quantity and quality report shall be made after discharge

    (c) Payment instrument shall be adjusted to match actual volume of cargo based on SGS report at the discharge port.

    (d) Discharge certificate from the Harbor Master of the discharge port.
