DAVIDSON POLICE ROAD KING MOTORCYCLES The City of Vancouver has only eight (8)
2000 Harley Davidson Police Road King FHLPI motorcycle remaining "as is, where
is" with the next two (2) units going on E-Bay mid- July. The City will accept
direct offers for any units not listed on EBay in approximately the $15,800
range plus taxes. These motorcycles will be declared as being a
Police/Emergency vehicle as required by British Columbia law. The motorcycles
were used by the Vancouver Police Department Traffic Section for enforcement,
motorcade, and drill team duties. The Vancouver Police Department uses Harley
Davidson's exclusively and has a fleet of over 30 motorcycles. Each
motorcycle is assigned to a few dedicated riders. Vancouver weather allows them
to be used throughout the year. They are kept indoors when not deployed. All
motorcycles are maintained on a regular basis by the City of Vancouver's
dedicated motorcycle repair facility. Service records will not be available
and individual questions regarding repair history will be declined. Each
listing will have the kilometres. All police decals, emergency lights, and the
siren have been removed. Factory emergency switches remain along with Harley
Davidson factory "Police" identification. The two front lamps used for
emergency strobes have been removed and previous purchasers have replaced
these with clear lamps. Both Federal Goods & Services Tax (6%) plus the
Provincial Sales Tax (7%) will be payable. Unit is to be transferred prior to
release by the City. Prospective buyers should ensure they qualify for such a
transfer. An original copy of the transfer form plus valid driver's license
must be presented for photocopying prior to release of the vehicle. Payment
shall be certified cheque, bank draft, or electronic funds transfer recognized
by a Canadian financial institution. The motorcycles will not be shipped.
The attached terms and conditions are applicable for this sale. Offers less
that $12,000 Canadian will not be considered. Units can be viewed between
0900 and Noon Monday to Thursdays at Central Stores, Manitoba Works Yard, 250
West 70th Avenue, Vancouver, B.C. No test rides will be allowed. TERMS
AND CONDITIONS 1. Offers are invited for the purchase and removal of a surplus
Harley Davidson Road King motorcycle located at the above address. Offers
shall be on an "as is - where is" basis and subject to the conditions of sale
set forth herein. Except as to title, the City makes no representations or
warranties, express or implied, as to merchantability, fitness for purpose, or
any other condition or quality. 2. Inspection prior to submitting an offer is
the responsibility of the prospective buyer. 3. The City of Vancouver
reserves the right to reject any or all offers or to negotiate partial sales,
pricing or terms and conditions with any prospective buyer(s) without the duty
to inform other prospective buyers. 4. The City reserves the right to withdraw
the equipment from sale at any time. 5. The successful buyer will be
responsible for the provision of insurance to protect the City's interests and
WCB(Worker's Compensation) coverage for their workers and any subcontractors
while working on City property. The successful buyer shall also ensure
compliance with occupational health, safety, and environmental regulations, for
the protection of their workers, City staff in the surrounding areas, and City
property. 6. The successful buyer releases the City from any or all liability
for personal injury, death, property loss, damage or destruction, or economic
loss resulting from the successful buyer's entry onto City premises and/or
removal of the equipment or subsequent use or operation of the equipment or
any items associated with it. The successful buyer also agrees to save the
City harmless from any or all claims arising from such events. 7. A deposit is
not required with any offers submitted. 8. Payment shall be made within five
(5) working days of written acceptance of the offer by the City. Certified
cheque, money order, electronic funds transfer, or bank draft, that are
recognized in Canada, are acceptable payment methods. 9. The Federal Goods and
Services Tax (6%) and Provincial Sales Tax (7%) will be charged unless an
exemption certificate is provided or the successful buyer is able to comply
with regulations for an out of province sale. 10. The City will not be liable
for loss, damage, or destruction from any cause whatsoever of the equipment
sold, but should any equipment be lost or destroyed during the period allowed
for removal and prior to actual removal thereof, the City will refund to the
successful buyer any monies paid as the price of, or on account of, the
equipment so lost or destroyed. 11. The successful buyer shall not assign or
transfer this contract without the written consent of the City. 12. In the
event that the successful buyer fails to remove the equipment within the time
specified in the agreed upon work schedule, the City may, without the prejudice
to any other remedies, cancel the contract and resell the equipment at such
price and on such terms as the City may deem advisable and hold the successful
buyer responsible for any loss including all expenses incurred by the City
through the default, but without any obligation on the part of the City to
account to the successful buyer for the proceeds of such resale. The City
shall be entitled to retain any amount paid on the account of the equipment
until the amount of any such resale (including the expenses referred to) shall
have been ascertained. 13. The successful buyer shall be required to produce
satisfactory proof of transfer from the City of Vancouver into their name
prior to removal of any vehicles from City property. 14. The City of Vancouver
will not be responsible for any failure in electronic communications that may
occur during an on line auction process.
